According to court records acquired by Rolling Stone, Drake’s legal team is alleging that the subpoena was not properly served nor accepted by the rapper and that it “places an unfair and burdensome burden” on him.

They further rejected the charges of his link in the trial, noting that “in a situation such as this, it is both unjust and oppressive to subpoena an out-of-state person who has not been mentioned in any reports, any inquiry, or cited to having any role in this matter.” The complaint says,

“Based on the information thus far disclosed in this case, there is a video which claims to depict the defendants purportedly as participants in the murder of the victim. No evidence has been offered to corroborate the accusation that Drake in any way contributed to, knew of, or participated in the alleged event and to compel that he attend deposition for something that he very plainly has no relevant knowledge of is unreasonable.”

The deposition subpoena was submitted by lawyer Mauricio Padilla, who is defending suspect Dedrick Williams.

Padilla stated in court that there were problems between XXXTentacion and Drake soon before his death, with the former accusing the Canadian artist of ripping off his single “Look At Me!” for “KMT.”

The attorney also highlighted a remark placed on XXXTentacion’s Instagram account that said, “If somebody attempts to murder me it was @champagnepapi. I’m snitching right now,” yet he subsequently claimed that his account was hijacked.
